This Distance Sales Agreement has been prepared in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation published in the Official Gazette No. 29188 of 27 November 2014. Matters not covered by this agreement are governed by that legislation.
1. Parties
1.1. Seller
- Company: 2M Giyim Kamp Malz. San. Tic. Ltd. Şti.
- Brand: Moose Mood
- Address: Gül Plaza, Meclis Mah. Atatürk Cad. No: 91/A Office: 2, Sancaktepe / Istanbul, Türkiye
- Phone: +90 551 836 22 77
- Email: siparis@moosemood.com
- Website: moosemood.com
1.2. Buyer
The Buyer is the person who places an order on moosemood.com and whose name or company name, delivery and billing address, phone number and email address are given in that order (the "Buyer"). These details appear in the order summary and in the order confirmation email.
2. Subject of the Agreement
This agreement covers the sale and delivery of the products that the Buyer orders electronically on moosemood.com. It sets out the rights and obligations of both parties in relation to that sale.
3. Products, Price and Payment
The name, key characteristics, colour, size and quantity of the ordered products are shown in the order summary. The same summary shows the sale price in Turkish lira including all taxes, any discounts applied, the delivery fee and the payment method. The order summary and the order confirmation email sent to the Buyer form an integral part of this agreement.
Prices shown on the website are valid until they are updated, and campaign prices are valid for the duration of the campaign. The Buyer pays the price in effect at the moment the order is confirmed. Price changes made after confirmation do not apply to that order.
Payment can be made by credit card, debit card or bank transfer (Havale/EFT). Orders paid by bank transfer are processed once the payment reaches the Seller's account. If payment is not made within the period stated on the payment page, the order may be cancelled.
For instalment payments, interest and instalment terms are governed by the agreement between the Buyer and the card-issuing bank. If a card is used unlawfully by someone else, the provisions of Bank Cards and Credit Cards Law No. 5464 apply.
4. Pre-contract Information and Formation of the Agreement
The Buyer acknowledges that, before confirming the order, they were informed of the Seller's identity and contact details, the key characteristics of the products, the total price including taxes, the delivery fee, the payment and delivery terms, and the conditions of the right of withdrawal. The Buyer declares that they confirmed this pre-contract information electronically.
The agreement is formed when the Buyer accepts the agreements at the payment step and completes the order. The Seller sends the order summary, together with the texts of this agreement and the Preliminary Information Form, to the Buyer's email address in the order confirmation email. The Seller keeps electronic records of the agreement and the pre-contract information for three years.
5. Delivery
Products are shipped to the delivery address given in the order through the Seller's contracted courier. Estimated preparation and delivery times are explained on the Delivery Information page. Under no circumstances will delivery take longer than 30 days from the date the Seller receives the order.
Delivery to a person other than the Buyer, where that person was named by the Buyer in the order, counts as delivery to the Buyer. The Seller is not responsible for delays caused by an incomplete or incorrect delivery address.
We recommend checking the parcel on delivery. If a parcel looks damaged, asking the courier to record a damage report helps us resolve the matter quickly. This recommendation does not limit the Buyer's statutory rights.
If the Seller finds that it cannot fulfil the order, it will inform the Buyer without delay. The Buyer may then terminate the agreement. The Seller will refund all payments received, including the delivery fee, within 14 days of the termination notice at the latest. No substitute product will be sent in place of the ordered item without the Buyer's explicit consent.
6. Right of Withdrawal
The Buyer has the right to withdraw from this agreement within 14 days, without giving any reason and without paying any penalty.
The withdrawal period starts on the day the product is delivered to the Buyer, or to a third party other than the carrier who has been named by the Buyer. Where products in a single order are delivered on different dates, the period starts on the day the last product is delivered. The Buyer may also exercise the right of withdrawal at any time between the formation of the agreement and delivery.
To exercise the right of withdrawal, it is enough to send the Seller a clear statement before the period expires. This can be done in any of the following ways:
- Members can create a return request for the order under My Account > My Orders.
- Anyone can send an email to siparis@moosemood.com.
- Anyone can complete the withdrawal form at the end of this agreement and send it by email or by post to the Seller's address.
The burden of proving that the right of withdrawal was exercised within the period lies with the Buyer. The steps of the return process are also explained on the Returns & Exchanges page.
7. Obligations of the Parties on Withdrawal
The Seller will refund all payments received from the Buyer within 14 days of receiving the withdrawal notice at the latest. If the Buyer withdraws from the entire order, the delivery fee is refunded as well. The refund is made in a single payment, using a method that matches the one the Buyer used to pay, and without any cost or obligation for the Buyer. Payments made by bank transfer are refunded to an IBAN provided by the Buyer and registered in the Buyer's name. The time it takes for a card refund to appear on the account statement depends on the bank.
The Buyer must send the product back to the Seller within 10 days of giving notice of withdrawal. If the product is sent with the contracted courier and return code provided by the Seller, the return shipping cost is borne by the Seller. If the contracted courier has no branch where the Buyer is located, the Seller will arrange for the product to be collected from the Buyer at no extra cost.
The Buyer is not responsible for changes or deterioration resulting from examining and trying the product during the withdrawal period in line with its function, technical characteristics and instructions for use. If the product is used beyond that purpose, or is damaged through the Buyer's fault, the Buyer is liable for the resulting loss in value. To help the return go smoothly, we kindly ask that products be sent back with their tags and packaging.
8. Exceptions to the Right of Withdrawal
Under Article 15 of the Distance Contracts Regulation, the right of withdrawal does not apply to the following:
- Products made to the Buyer's specifications or clearly personalised for the Buyer. This includes items produced specially for the Buyer with a name, print or custom measurements.
- Products whose hygiene seal, tape or protective packaging has been opened after delivery and which are unsuitable for return for health or hygiene reasons. This includes items worn directly against the skin, such as underwear and swimwear.
- Services performed immediately in electronic form and digital content delivered to the Buyer immediately.
- Any other cases listed in the Regulation.
9. Defective Products
The Seller must deliver the product free from defects and in line with the characteristics stated in the order. If the product turns out to be defective, the Buyer may choose one of the following remedies under Article 11 of Law No. 6502:
- Return the product and withdraw from the agreement.
- Keep the product and ask for a price reduction proportionate to the defect.
- Ask for the product to be repaired free of charge.
- Ask for the product to be replaced with a defect-free equivalent.
All costs of exercising these remedies are borne by the Seller. Claims relating to defective products become time-barred two years after delivery, even if the defect appears later. This time limit does not apply where the defect was concealed through gross negligence or fraud. For errors on the Seller's side, such as a wrong or missing item, please contact us at siparis@moosemood.com.
10. Personal Data
The Buyer's personal data are processed to fulfil the order and to meet legal obligations. They are protected according to the principles explained in the Protection of Personal Data and Privacy and Security notices.
11. Dispute Resolution
For disputes arising from this agreement, the Buyer may apply to the consumer arbitration committee where they live or where the transaction took place, within the monetary limits announced each year by the Ministry of Trade. Disputes above those limits fall under the jurisdiction of the consumer courts. Under Article 73/A of Law No. 6502, mediation is a mandatory step before a case can be filed with a consumer court. Applications to consumer arbitration committees can also be made online through the Consumer Information System (TÜBİS) on e-Devlet.
12. Entry into Force
By confirming the order, the Buyer declares that they have read and accepted all terms of this agreement. The agreement applies in the version in force on the date the order is confirmed.
